Although contractors will conduct a full briefing when the equipment is installed it is likely to prove much more effective if the sentencer underlines the importance of full compliance at the point of sentencing.
Experience indicates that a key factor in the success of electronic monitoring is that the offender is made clearly aware of the need to comply fully with the terms of the curfew order and of the severity of the consequences of failing to do so. This is a requirement under Section 12 (5) of the Criminal Justice Act 1991.
Sections 99 and 100 of the Crime and Disorder Act 1998 provide for a new electronically monitored licence (home detention curfew) which will provide a more managed transition from prison into the community. The new provisions came into effect on 28th January 1999.
