Home Detention Curfew


Curfew conditions to be included in licence

Section 100 establishes the terms of the Home Detention Curfew and provides for it to be monitored electronically by a specified person. The curfew must be at least nine hours per day (excluding the first and last days of the curfew). It can also be for different periods and at different places on different days.

The Secretary of State may revoke a licence and recall an offender to prison on the following grounds:


Once a licence has been revoked, the offender will be liable to be detained and if at large will be unlawfully at large.

An offender whose licence has been revoked will be entitled to make representations against that decision and will be informed of his or her right to do so and of the reasons for the revocation. When a revocation is cancelled on this basis, the offender shall be treated as though he or she had never been recalled to prison.
