Home Detention Curfew

Violations and Breaches

There are 2 levels ofviolation:

Level 1 violations are a breach of cuffew and result in immediate return to court

They are defined as:

missing a full curfew period (or all of the periods in 24 hours);

violence or threat of violence against the contractor;

serious damage to the equipment (including removal of the 'tag').

Level 2 violations result in a warning letter. A maximum of two warning letters are currently sent before the offender is returned to court.

Level 2 violations are specified as:

single absence of more than 2 hours in any period of 24 hours;

absences totalling more than 2 hours in a calendar month or 3 hours over the duration of the curfew;

causing minor damage to the equipment.
