Home Detention Curfew

The contractors are responsible for returning offenders to court in cases of breach. A designated Responsible Officer from the company concerned will present the evidence of breach to the court.

It is the responsibility of the court to determine whether the order has been breached and if found to have been so, to decide what action should follow

The trials demonstrated the variety of options used by the courts in the event of a breach of a curfew order being proven. These included revocation of the order and the imposition of a prison sentence, and an increase in the severity of the curfew conditions by lengthening the duration of the order or by increasing the number of days and/or hours of the curfew

Breach Hearings after the Curfew has Expired

Breaches can be considered after the curfew has expired providing the information is laid before the court prior to the date of expiry of the order.

Breach of a Combined Order

This must result in re-consideration of both parts of the order even in situations where only one of the orders has been breached.
