Each agency has an important role to fulfil in achieving a successflal outcome. The key tasks of each agency are as follows:
Sentencer
Determine the appropriateness of the sentence;
consider the suitability of the offender;*
set the place(s) of curfew;
assess the suitability of the place of curfew;*
consider the impact on others at the same address;*
determine the duration of sentence
set the days/hours of curfew bearing in mind educational, employment, and religious commitments;
consider requests for variations of address and/or hours of curfew;
consider evidence of breach;
determine appropriate action in case of proven breach.
* Usually assessed by the Probation Service when a Pre- Sentence report has been requested.
Probation Service
The role of the probation service is to provide information and advice to the courts.The court probation officer, when requested by the court, will take the following actions:
Assess the suitability of the offender for electronic monitoring;
investigate the availability of a fixed address;
assess the place(s) of curfew;
assess the impact on others at the same address;
assess the likelihood of a successful outcome;
report on any factors impacting on the days/hours of curfew;
report on existing orders;
supervise other parts of the sentence in combined orders.
Most of the above factors are usually investigated and documented as part of a Pre-Sentence Report.
Contractor
The role of the contractor is to provide the following services to the court in strict accordance with the terms of their contract:
Install the equipment,
brief the offender and the family on all of the factors affecting monitoring;
monitor the offender;
investigate reported violations;
record violations and the evidence that supports them;
report breaches of curfew to the court and to the probation service where appropriate;
return the offender to court as required by the terms of the contract.
