7. REMOVAL OF DISQUALIFICATION

A defendant who has been disqualified may apply to the court for the removal of the order. There is a time scale to be observed before he can apply:-

a) If the disqualification is less than 4 years he may apply after 2 years.

b) If it is between 4 and 10 years he may apply after one half of the period.

c) In any other case he may apply after 5 years. The application is made to the court which imposed the disqualification and a summons is issued to the Chief Superintendent of Police for the area. If the application is granted the disqualification may be removed immediately OR with effect from some future date. The disqualification may not be removed in part. If the application is refused he must wait another 3 months before the next application.
